TERMS OF USE

(Design-Build Register – Owned by Remodelers Advantage, Inc.)

1. Acceptance of Terms

These Terms of Use (“Terms”) govern access to and use of the Design-Build Register (the “Register”), owned and operated by Remodelers Advantage, Inc., a Maryland corporation (“Remodelers Advantage,” “we,” “us,” or “our”).

By accessing or using the Register, you agree to be bound by these Terms. If you do not agree, you must not use the Register.

2. Nature of the Register

The Register is an informational resource identifying companies that participate in a defined professional framework administered by Remodelers Advantage.

The Register is not:

  • A licensing authority

  • A certification body

  • A regulatory agency

  • A bonding or insurance entity

Remodelers Advantage does not supervise, direct, or control the operations of listed companies.

Inclusion reflects participation at the time of listing only.

3. No Reliance; Independent Due Diligence Required

The Register is provided for informational purposes only.

You acknowledge and agree that:

  • Inclusion does not constitute endorsement or guarantee.

  • Remodeling and construction projects carry inherent risks.

  • You are solely responsible for conducting independent due diligence before entering into any contractual relationship.

You agree not to rely solely on inclusion in the Register when selecting a remodeling partner.

4. No Agency Relationship

Use of the Register does not create any agency relationship, partnership, joint venture, fiduciary duty, or representative relationship between you and Remodelers Advantage or between Remodelers Advantage and any listed company.

All contractual relationships exist solely between you and the selected company.

5. Limitation of Liability

To the maximum extent permitted by law, Remodelers Advantage, Inc., its affiliates, officers, directors, employees, agents, contractors, and representatives shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, economic, lost profit, property, or personal injury damages arising from or related to:

  • Use of the Register

  • Reliance on Register content

  • Inclusion or exclusion from the Register

  • The performance or conduct of any listed company

  • Errors, omissions, or inaccuracies

Use of the Register is at your own risk.

6. Indemnification

You agree to indemnify, defend, and hold harmless Remodelers Advantage, Inc. and its affiliates from any claims, liabilities, damages, losses, costs, or expenses (including attorneys’ fees) arising from:

  • Your use of the Register

  • Your reliance on Register information

  • Your dispute with any listed company

7. Dispute Resolution – Mandatory Arbitration (Maryland)

Any dispute, claim, or controversy arising out of or relating to these Terms, use of the Register, or reliance upon Register content shall be resolved exclusively through binding arbitration.

Arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

Arbitration shall take place in the State of Maryland unless otherwise agreed in writing.

These Terms shall be governed by and construed under the laws of the State of Maryland, without regard to conflict-of-law principles.

8. Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted solely on an individual basis.

You waive any right to:

  • Participate in a class action

  • Participate in a collective action

  • Act as a class representative

  • Join claims with other users

9. Jury Trial Waiver

To the fullest extent permitted by law, you waive the right to a trial by jury in any dispute relating to the Register or these Terms.

10. Severability

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.

11. Modifications

Remodelers Advantage reserves the right to modify these Terms at any time. Continued use of the Register after changes are posted constitutes acceptance of the modified Terms.

12. Entire Agreement

These Terms constitute the entire agreement between you and Remodelers Advantage regarding use of the Register.
